The Student Online Personal Information Protection Act “aggressively protects the use of student educational data by third-party vendors.” (Government Technology, 2014) SOPIPA prohibits online education service operators from selling student data, using student data for advertising and/or from collecting student data for non-educational purposes.
As a future leader, the steps I would put into place in the school or district I am studying in order to comply and/or protect our student data is to ensure to ensure none of the current and past data records have been compromised and/or used for profit. If so, I would request and require operators of the educational websites, online services, and applications we used in the past or present to delete student’s information.
I would also advise current leadership to begin researching ALL student data protection laws (SOPIPA, FERPA, COPPA, and CIPA) and ensure teachers are educated and aware of these laws. SOPIPA places the responsibility on the vendors to ensure they are not selling or using student data for non-educational purposes, however leadership and teachers must be aware because there are new applications/software that is released daily. Leadership must analyze and ensure they are following the student data privacy laws that exist. The tech TOSA’s must be educated as well and begin ensuring all applications that are currently being used are safe and free from internet harm.
